A federal consultation on ropeless lobster gear is open until the middle of October, and the industry it targets has spent the past year making its position impossible to misread.
The notice, published by the National Marine Fisheries Service in the Federal Register on 16 July, asks 52 questions over seven pages. It covers crew safety, retrieval success, premature releases, how unmarked gear should be identified, how boats avoid fouling each other's traps, enforcement, training, and who should control the location data. Comments are due on or before 14 October, and NOAA has said it will publish a public summary of the responses. The Small Business Administration's Office of Advocacy alerted small operators to the notice on 4 August.
There is a statutory deadline underneath the exercise. Congress, through the Consolidated Appropriations Act of 2023, froze the Atlantic Large Whale Take Reduction Plan until the end of 2028 while also requiring NMFS to have new whale-protection rules for lobster and crab gear in force by 31 December of that year. The request for information is focused on the Greater Atlantic region but accepts input from anywhere on-demand systems are being fished.
The technology keeps the rope and buoy on the bottom with the trap and releases them acoustically when the boat comes back, which takes the vertical line out of the water column entirely. That line is the main entanglement risk for North Atlantic right whales, of which about 356 remain, fewer than 100 of them females of breeding age.
None of this is hypothetical for NOAA. The agency's June bulletin recorded 832 hauls on 17 vessels across three on-demand gear brands between 1 February and 30 April, fished in state and federal waters closed to static vertical lines. That was the fourth season of fully on-demand testing inside restricted areas, and the sixth year of broader on-demand trials in the region.
Canada has already decided. Its Whalesafe Fishing Gear Strategy, published on 3 February and supported by a C$258.1 million whale-protection commitment, would set aside zones where on-demand or weak-rope gear is the normal way to fish rather than something permitted only after a whale detection closes an area.
"We believe this is going to be part of a modern fishery going forward. It's a tool critical to allow harvesters to fish while whales are present," said Brett Gilchrist, director of national programs at Fisheries and Oceans Canada.
Maine, source of roughly 90 percent of US lobster, has drawn the opposite conclusion. The Maine Lobstermen's Association estimates a fleet-wide changeover would cost at least $45 million and warns that the ongoing expense would squeeze out the small independent boats the fishery is built on.
"Because of the expense of running a system, we are afraid that it's going to force some consolidation of our fleet," MLA executive director Patrice McCarron told Maine Public in May. "The key to success of the Maine lobster fleet has been that we're owner-operators... that the money we're earning is being spent in our local, rural, coastal communities."
For the New England Fishermen's Stewardship Association, the objection starts with the crew rather than the balance sheet. Executive director Dustin Delano, himself a former lobsterman, told National Fisherman that the endline is frequently what saves a man who goes over the rail.
"If somebody gets tangled in ropeless gear and goes overboard, you're not going to get them back," Delano said. On finding gear that leaves nothing on the surface, he was equally direct: "For that to work, the accuracy would have to be a small fraction of a mile. And our plotters are not perfect."
The fleet has had political backing. Ahead of a New England Fishery Management Council vote last September on an alternative gear-marking framework, Representative Jared Golden wrote to executive director Cate O'Keefe calling the proposal "premature and unnecessary" and warning it would cut against the moratorium Congress had passed. The council delayed the decision unanimously.
"Forcing unproven ropeless gear onto our industry without reliable testing, interoperability or regard for safety would devastate small operators and coastal communities," Delano said of that framework.
Ginny Olsen, executive liaison and political director of the Maine Lobstering Union Local 207, made the same point about timing. "There are still so many questions about this technology, but there's one thing we know for sure: If we had to adopt it today, it would put Maine fishermen out of business," she said.
Senators Susan Collins and Angus King took the argument to NMFS assistant administrator Eugenio Pinero Soler in an April letter, pressing the agency to give the fleet's concerns real weight and to keep working on alternatives such as dynamic area management with Maine's Department of Marine Resources. "A single, uniform solution, particularly one that mandates technology that is not yet proven at scale, is not the right path forward for this fishery or for the conservation goals we share," they wrote.
The economics are not entirely one-sided. Research published in Marine Resource Economics found consumers would pay an average of $3.42 extra for a lobster roll when told the lobster had been caught with ropeless gear, with animal-welfare framing producing the strongest response.
Qiujie "Angie" Zheng, associate professor of business analytics at the University of Maine's Maine Business School, led the work and has been careful not to let it be read as advocacy.
"These findings do not suggest that Maine's lobster industry needs to change its current practices," Zheng said. "Rather, they provide insight into how consumers might respond if ropeless technology were adopted."
She also framed the cost as shared rather than assigned. "Right whale conservation is a collective effort. In addition to the fishermen, regulators and scientists, consumers play a role, so we hope this research helps understand consumer preferences and evaluations," Zheng said.
What the consultation has to resolve is less a question of engineering than of allocation: who pays, whether competing manufacturers' systems will interoperate, and how a crew safely works gear it cannot see from the wheelhouse. The window shuts on 14 October.
